Oregon break, overtime and sick leave rules
Meal and rest breaks, overtime and paid sick leave in Oregon, in plain words. Last reviewed October 31, 2026. Not legal advice.
The rules in Oregon#
- Meal breaks
- A 30‑minute meal period with relief from all duty for each work period of 6 to 8 hours, between the 2nd and 5th hour (7 hours or less) or the 3rd and 6th hour (over 7 hours). Where the employer cannot relieve the employee, a paid on‑duty meal period is required.
- Rest breaks
- A paid 10‑minute rest period for every 4 hours worked or major portion (more than half of it), near the middle of each work segment, in addition to the meal period.
- Overtime
- 1.5 times the regular rate after 40 hours in a workweek. Daily overtime after 10 hours applies only in certain canneries, driers, packing plants, mills, factories and manufacturing establishments. No double time or seventh‑day rule.
- Paid sick leave
- Employees earn at least 1 hour per 30 hours worked, up to 40 hours per year (or 40 hours front‑loaded). Paid for employers with 10 or more Oregon employees (6 or more with a Portland location); otherwise protected but unpaid.
How Oh! Thyme handles Oregon#
Oh! Thyme has a Oregon rule set, turned on for your company at setup. On every shift it checks:
- Overtime after 40 hours in a workweek
- A 30‑minute meal break that starts by the end of hour 5
- A paid 10‑minute rest break for every 4 hours worked, or more than half of that
- Sick leave balances build from approved hours at the rate set for each person, such as 1 hour per 30 worked, stop at their cap, and come down when time off is approved.
A day that breaks a rule is flagged for the approver before the hours go to payroll.
Not checked in Oregon: that the meal comes after the 2nd hour of the work period.
